It is our aim to provide you with the very best we can source in chocolates and gift confectionery. The terms and conditions set out below are applicable to the supply of products from www.sugar-and-spice.co.uk, the buyer, hereafter referred to as the Customer. We stock many items from many different manufacturers. It is with regret that we are unable to assure you that the products we supply will not have traces of nuts.
2. CUSTOMER CONFIDENTIALITY
2.1 We do not disclose customer information to third parties.
2.2 We do not collect information deemed 'sensitive' under the Data Protection Act 1998. Your contact details (but NOT your credit card details, see below) are retained on a restricted access system within our internal systems, which is in keeping with both our security policy and the law.
2.3 Occasionally we may collect information to enable us to inform you of new products or promotions.
3.1 All prices are quoted in Pounds sterling.
3.2 All prices are inclusive of VAT at 20%.
3.3 Sugar & Spice takes every care to ensure information and prices are correct and withholds the right to make any price changes it deems necessary.
4.1 Payment must be made in Pounds sterling only by one of the following payment methods:
Major credit cards as listed: Mastercard, Visa, Switch, Solo, Visa Delta
4.2 Sugar & Spice does not retain your credit or debit card details on its systems. When you reach the page for entering your card information, you are connected directly to the RBS WorldPay secure server. RBS WorldPay are our payment service provider and will process any charges or refunds to your card.
5. TRANSFER OF RISK
The risk in the goods shall fully pass to the Customer once the goods have been delivered by our nominated transport provider and signed for.
6.1 All products shown are despatched from our shop in Largs. Unless requested by the Customer, most products will be delivered by Royal Mail 1st class post or Interparcel for heavier items which must be signed for at the time delivery is made. The Customer must request any alternative delivery method at the time of ordering and goods will be despatched at the Customer's own risk.
6.2 Sugar & Spice aim to deliver all goods within 2-3 working days from processing of payment. We do not despatch goods over the weekend. Despatch normally takes place within 24 hours of payment being processed. Any orders that will exceed 28 days to fulfill the Customer will be notified by email and will be offered the option of order cancellation and a refund of payment. Any products not available at the time of ordering will be despatched as soon as possible. Sugar & Spice cannot be held responsible for delays in the delivery caused by our suppliers or transport providers.
6.3 If a product is not in stock, we will back order it for you; you will be emailed with the option to cancel your order if you would rather not wait. This does not affect your statutory rights as a customer. We endeavour to stock every item shown on our website at all times with the exception of seasonal items such as Easter, Christmas goods etc.
The Customer shall inspect the goods within a reasonable time period after delivery and shall be deemed to have accepted the goods, unless, within a reasonable time period after their delivery, the Customer notifies Sugar & Spice that the goods are rejected. If no notification of rejection is received within 7 days, Sugar & Spice will consider the products being as described, of satisfactory quality and therefore reserve the right not to accept any rejection of goods at a later date.
8. RETURNS / REFUND POLICY
8.1 If the goods are rejected within the timescale as defined in Clause 7, the Customer shall comply with the Sugar & Spice returns procedure as stated below. Sugar & Spice will not accept any returned goods should the returns procedure not be followed.
8.2 The Customer must contact Sugar & Spice by either telephone or email to obtain a returns authorisation. An authorisation code will be issued and must be referred to in all correspondence. This number must also be clearly marked on any return packages. Sugar & Spice will arrange for the relevant packages to be collected from the Customer. A collection charge will apply to returns where goods are not damaged or faulty.
8.3 In cases where the goods are rejected within the specified time, the Customer is entitled to a full refund or replacement. The faulty or damaged products must be returned to Sugar & Spice before the refund or replacement can be issued. Refund is within 30 days of cancellation.
9.1 Cancellations are only accepted if the Customer complies with Sugar & Spice's cancellation procedure and before any goods have been despatched. If the order has been despatched prior to the cancellation, the returns procedure as defined in Clause 8 (8.2 and 8.3) above will apply. If the procedure is not followed, the order will be considered valid and the Customer will remain liable for the full payment.
9.2 Cancellations can only be made by e-mail directly with Sugar & Spice. Please remember, order despatch normally takes place within 24 - 48 hours.
These terms and conditions are governed and shall be interpreted in accordance with UK law.
